‘Women cannot be forced to test virginity’, know why Chhattisgarh High Court said this

Bilaspur: Chhattisgarh High Court comments have come to light on women’s virginity. The High Court said, ‘No woman cannot be forced to have a virginity test. This is a violation of Article 21 of the Constitution. This article guarantees the fundamental right to protect the woman with the right to honor, including the right to honor.

What else did the High Court say?

The High Court said that permission for virginity test would be against the fundamental rights, major principles of natural justice and the shame of women. The court emphasized that Article 21 is “heart of fundamental rights”.

High Court Judge Justice Arvind Kumar Verma’s remarks came in response to a criminal petition filed by a person, demanding his wife’s virginity test, alleging that he was in an illegal relationship with another person. He challenged the order of a family court of October 15, 2024, which rejected the interim application.

In this case, the wife had alleged that her husband is impotent and is denying cohabitation. The High Court said that if the petitioner wants to prove that the allegations of impotence are baseless, he can conduct a concerned medical examination or present any other evidence. But ‘he cannot be allowed to conduct a virginity test of his wife and to complete the shortage in his evidence.’

The order passed on 9 January was recently made available. The High Court said that the petitioner demanding his wife’s virginity test is unconstitutional, as it violates Article 21 of the Constitution, including the right to honor women. Article 21 of the Constitution of India not only guarantees the right to life and personal freedom, but also gives the right to live with respect, which is important for women. (Input: PTI)
