Donald Trump’s White House is scheduled to complete three months, there is speculation that the Republican President may declare martial law in the US on April 20. These speculations are being set up when a large part of the US population assumes that Trump in the US will implement the Rebellion Act of 1807 and will implement martial law on next Sunday. These rumors stems from the President’s orders that Trump issued after taking oath at the White House on 20 January.
After taking over after taking charge after the swearing -in ceremony, Trump declared a ‘national emergency’ on the southern border with Mexico, saying “America’s sovereignty is being attacked.” There was a condition in Trump’s order- President Donald Trump “can implement the Revolt Act of 1807 and possibly signed an executive order to deploy army on US earth on 20 April after ninety days.
Why is there a stir on 20 April
Trump’s executive order stated, “Within 90 days from the date of this announcement, the Defense Secretary and Homeland Security Secretary will submit a joint report to the President about the Southern border conditions of the United States and make recommendations about additional action which may be necessary to obtain full operating control on the southern border, including the implementation of the 1807 Rebellion Act.
What is the Rebellion Act of 1807?
According to the Rebellion Act of 1807, the President of the United States may allow the deployment of the Army and the US National Guard to ensure that the law is applied in some situations and circumstances. It gives the army the right to fully suppress any rebellion or any work of violence or resistance, including the work done by the citizens.
The Rebellion Act has powers of overriding the Pos Committess Act, which usually remains in force at all times, and prevents the US Army from participating in any civil law enforcement or interfering. This gives full power to decide when, where, where to deploy American soldiers within the United States.
Is the Rebellion Act similar to martial law?
However, the Rebellion Act is somewhat different from the martial law. While the martial law gives complete control to the administration and the state’s affairs to a military general – the Chief or Army Chief of the Defense Employees – Rebellion Act to the State and Administration to the US President, with the US President, who makes selective uses of military powers to implement law and order.
In other words, the Marshall Law allows the army to take the role of a civil government in the Emergency, the Rebellion Act allows the army to only assist the civic officers, not to replace them.
‘Can it be misused’
Legal experts have long argued that the Revolt Act of 1807 is old, dangerously unclear and requires immediate improvement. According to the Brain Center for Justice, “there is a need for major changes in the Rebellion Act.” It argues that the Revolt Act “gives the President the right to deploy the US Army at a domestic level and use it against the Americans under certain conditions. However, there are rare conditions in which such rights may be necessary, but the law, which has not been updated meaningfully in more than 150 years, is extremely superficial and ready to misuse.”
The advocacy group also states that “the text of the Rebellion Act does not define any other major words used in determining ‘rebellion’, ‘rebellion’, ‘domestic violence’ or pre -deployment.” It argues that it is dangerous for abuse.
What will happen on 20 April?
There is now less than a week left for the end of the 90-day period mentioned in the 20 January Executive Order, and now a large part of the US population is beginning to assume that President Donald Trump will actually “enforce the Rebellion Act” and deploy the army on 20 April.
On January 22, 2025, two days after Trump’s Executive Order, the US Department of Defense announced that it would send 1,500 active-duty-duty service members to the southern border with additional air and intelligence properties to assist other federal agencies working to implement border security and other branches of service.
In an update on January 29, 2025, Defense Secretary PT Hegaseth confirmed that his department intends to keep 30,000 criminal migrants at Guantanamo Bay, Cuba, after the President’s announcement that he would sign an executive order to direct the Defense Department to do so.
But since then, no significant updates have been shared. The Defense Secretary and Homeland Security Secretary have not yet submitted their final report to the US President, and have not informed them about the achievement of the mission so far. This is why many people are convinced that the old law will be implemented soon to achieve “full control on the southern border” – which is the goal of the current administration.
