Supreme Court Updates: SC rejects Jharkhand plea HC order quashing FIR against Nishikant Dubey Manoj Tiwari

Jharkhand government has received a big blow from the Supreme Court. The court has rejected Jharkhand’s plea against the High Court order quashing the FIR against BJP MPs Nishikant Dubey and Manoj Tiwari. The FIR was lodged in case of violation of aviation rules while taking off from the airport in 2022.

According to news agency PTI, the Supreme Court rejected the Jharkhand government’s plea challenging the High Court’s order to quash the FIR against Bharatiya Janata Party (BJP) MPs Nishikant Dubey and Manoj Tiwari. They are accused of pressurizing air traffic control to allow their aircraft to take off from Deoghar airport after sunset in 2022.

A bench of Justices AS Oka and Manmohan allowed the state government to send the material collected during the investigation to the authorized officer under the Aviation Act within four weeks. The bench said that the competent authority of the Directorate General of Civil Aviation (DGCA) will decide in accordance with law whether there is a need to file a complaint under the Act or not.

The decision was reserved on 18 December

The apex court had on December 18 reserved its verdict on the state government’s appeal against the Jharkhand High Court’s decision. The case pertains to the FIR lodged against nine people including Dubey and Tiwari at Kunda police station in Deoghar district of Jharkhand. The MPs had pressurized the ATC personnel at Deoghar airport to give clearance to their private aircraft to take off after the scheduled time on August 31, 2022, allegedly in violation of airport security protocols.

Decision came on a petition of Jharkhand government

The top court’s decision came on a petition by the Jharkhand government, challenging the high court’s March 13, 2023 decision. The high court had quashed the FIR on the grounds that as per the Aviation (Amendment) Act, 2020, no prior approval was taken from the Lok Sabha Secretariat before filing the FIR.
